San Rafael man receives 44 day jail sentence for beating puppy

Marin Humane Society advocates zero tolerance for animal cruelty

(NOVATO, CALIF. , March 11, 2009) — A San Rafael man has been sentenced to 44 days in jail, and is prohibited from owning any animals, for beating his Chihuahua puppy “Scooby” in August 2008. Jose Cardenas, 20, was sentenced this morning by Judge Kelly Simmons.

“We are thrilled that justice has been served” said Captain Cindy Machado, Director of Animal Services for the Marin Humane Society. “This sentence sends a clear message that animal cruelty is not tolerated in Marin County.”

The investigation began on August 27, when authorities received an anonymous tip from a resident on North San Pedro Road about someone beating a Chihuahua. A Marin Humane Society animal services officer arrived to find the 6-month-old dog needing emergency treatment; he had bruises, was limping and lethargic.

Scooby was taken to the Pet Emergency & Specialty Center of Marin where he was diagnosed with hemorrhaging to the left eye, bruising to his legs, chest and right ear, and fluid in his lungs.

“Fortunately, this story has a happy ending,” said Carrie Harrington, MHS Communications Manager. “After spending several weeks recovering in a foster home, Scooby was adopted to a wonderful family in Novato.”
